1. Acceptance of Terms
By accessing or using LeadClap ("Service"), operated by LeadClap ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms apply to all users of the Service, including workspace owners, members, and anyone who accesses the Service.
2. Description of Service
LeadClap is a lead management platform that enables users to capture form submissions, organize leads, configure notification destinations, manage teams via workspaces, and track lead activity. The Service includes the web application, APIs, embed scripts, and related documentation.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 16 years old to use the Service.
- One person or entity may not maintain more than one free account.
- You are responsible for all activity that occurs under your account.
4. Workspaces & Teams
Workspace owners are responsible for managing access, permissions, and the data within their workspace. When you invite team members to a workspace, you grant them access to shared lead data and workspace settings according to the roles and permissions you configure.
5. Acceptable Use
You agree not to use the Service to:
- Collect data without proper consent from the individuals whose data is being captured
- Send spam, unsolicited messages, or engage in abusive communication
- Violate any applicable laws, regulations, or third-party rights
- Transmit malware, viruses, or other harmful code
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service for any illegal or unauthorized purpose
6. Data Ownership & Responsibility
You retain ownership of all lead data and content you submit to the Service. By using LeadClap, you grant us a limited license to process, store, and transmit your data solely to provide the Service to you.
You are the data controller for any personal information captured through your forms. You are responsible for ensuring you have the appropriate legal basis (such as consent) to collect and process such data, and for complying with applicable data protection laws including GDPR, CCPA, and others.
7. Plans & Billing
- Free plans are subject to usage limits as described on our pricing page.
- Paid plans are billed monthly or annually as selected at the time of purchase.
- Prices may change with 30 days' advance notice.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- Refunds are provided at our discretion and are not guaranteed.
- If you exceed your plan limits, we may throttle or restrict access until you upgrade or usage resets.
8. API & Integrations
The LeadClap API and embed scripts are provided for integrating lead capture into your websites and applications. You agree to:
- Keep your API keys confidential and not share them publicly
- Not exceed reasonable rate limits
- Not use the API to build a competing service
- Comply with any additional API-specific terms we publish
9. Destinations & Notifications
LeadClap allows you to configure notification destinations (email, Telegram, etc.) for lead delivery. You are solely responsible for ensuring that notifications are sent to authorized recipients and that your use of these channels complies with the terms of service of those third-party platforms.
10. Availability & Support
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance that temporarily affects availability. We will make reasonable efforts to notify you in advance of planned downtime. Support is provided according to your plan tier.
11. Intellectual Property
The Service, including its design, code, logos, and documentation, is owned by LeadClap and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
12. Limitation of Liability
To the maximum extent permitted by law, LeadClap shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.
13. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. You may export your data before termination where technically feasible.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
